Um, if she did take Clenbuterol, then yes, she did commit a crime as that is not available in the US by prescription.
I'm not sure it is illegal to possess this drug. Doctors just can't prescribe it.
I think people can possess medications that are legal in other countries unless the drug is specifically named as illegal.
BTW - this has nothing to do with wrong or right on use of this drug as a PED - it is obviously wrong. I am just not sure Hardy is a criminal.
On the topic of reliable tests - I believe these tests are generally reliable at not producing false positives. I tend to believe they may fail to detect many PEDs, but they don't falsely detect them. Some of them are very clear because the markers for the substance are distinct. Others like EPO rely on levels of substances that already exist in the body (such as hematocrit).
I'll say again that even if Hardy put this substance in her body unintentionally she cannot compete in the Olympics because she had a PED in her system during her races. Her win over Tara Kirk and others was not fair.
