I was thinking of doing this event in October but all the information available about
this venue is negative, and that it is illegal to swim. Is there someone from Austin
on the forums that has some opinions?

I've done the Cap 2K several times in Lady Bird Lake from Red Bud Island to the Rowing Center. The Sharkfest swim is a bit further down river but I'd expect the conditions to be similar. No issues with water quality. It's a very pretty venue and Austin is an amazing city to visit. I'm planning to enter the Sharkfest swim and think you'd enjoy swimming there.
I have swam 7 or 8 Cap 2Ks too in Lady Bird Lake / the former Austin Town Lake... occasionally big rains can spike fecal coliforms or e.coli in lady bird and the upriver highland lakes. County Health District and TCEQ keep good tabs on this. Do not know where you're commuting from but I have to recommend a visit, and swim, in Austin, TX.
