latycar issue

Can someone explain to me why the latycar issue isn't a simple matter of determining whether the meet has an appropriate sanction from a duly authorized body? Surely there should be documentation that answers that question? This issue has just erupted up here north of the border and frankly I don't understand it.

    Within the FINA Constitution (on their website: fina.org under Rules and Regulations), a provision allows disputes to be moved to a Court of Arbitration for Sports (CAS in Lausanne ?Switzerland) under item C 25. The finding of the CAS are final and binding. Otherwise, I do not see any other provisions to hold FINA accountable for their actions.
